The European court has forbidden to send to jail illegal migrants

On Tuesday, June 7, the European court of justice in Luxembourg have banned the authorities of European countries to send to jail migrants just because they illegally entered the country.

The court decision said that instead of putting migrants under arrest, they should be sent back to the state from which they came.

The regulation applies to immigrants detained at passport control at the entrance and at the exit from the Schengen area.

The BBC website notes that the decision was made on the basis of the case with the arrest by French police of a citizen of an African country who tried to enter the country on a forged Belgian document.
